Get a lower / nil TDS certificate
Buyers often deduct TDS on the full sale value. We help NRIs apply for a lower deduction certificate (Form 13), file ITR and handle repatriation (Form 15CA/15CB).
How tax applies when an NRI sells property
Gains on property held over 24 months are long-term (taxed at 12.5% without indexation for transfers after 23 July 2024), otherwise short-term (slab rates). Surcharge and 4% cess apply. Buyers must deduct TDS under section 195 on the applicable amount.
Why TDS is often higher than the tax
If the buyer deducts TDS on the full sale consideration (common without a certificate), the TDS can far exceed the real tax on the gain. You can apply for a lower/nil deduction certificate in advance or claim the excess as refund through ITR.
Repatriation
Sale proceeds from property can be repatriated through authorised dealers within FEMA limits (generally up to USD 1 million per financial year from NRO), supported by Form 15CA/15CB. Confirm current limits.
Exemptions
Reinvestment under section 54 (residential house) or 54EC (specified bonds) can reduce taxable gains. Not modelled here.
